Terms

In the following terms and conditions “the Photographer” shall mean “Atlas photography”. “The Client” shall be those persons responsible for booking the photography services. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of these terms shall be effective unless agreed by both parties in writing.

Acceptance

Acceptance of a photoshoot with Atlas Photography indicates that you have read, understood, and agreed to all the terms and conditions as set out in this document in its entirety.

Cancellation Policy

Once you have booked an appointment with Atlas Photography we will reserve time in our schedule exclusively for your photoshoot. Should you need to cancel or change your booking, you can do without penalty up to 72 hours prior to your arranged appointment with us. However, should you need to cancel or reschedule within 72 hours of your arranged appointment time then your pre-paid booking deposit will be retained as we will be forfeited as the time scheduled with our photographers. Archive & Storage

Atlas Photography archives all photographs purchased by the client after a period of 60 days from the date of the Session. After that time, the Photographer reserves the right to delete all photographs from its storage. Any images not purchased by the client at the preview are deleted upon completion of the work when the client is supplied with their completed images. The Photographer is not responsible for the photographs once they are delivered to the Client. The Client is solely responsible for keeping the photographs in a safe place and for making back-up copies of any photographs that are delivered to the Client. Should a copy of the images be requested from the Photographer more than 60 days after the Sessions completion, a £75 fee is chargeable to retrieve the images from the archived storage.

Copyrights & Ownership

The Photographer reserves the full copyright to all the photos taken during the photography shoot. However, the Photographer grants the Client a non-exclusive, non-transferable license to use the photos for unlimited personal use only. Sale, publication, or any other commercial use of the photo by the Client is specifically prohibited without the prior written consent of the Photographer. The Photographer asserts the right to be credited as the author of the photographs in accordance with sections 77 and 78 of The Copyright, Designs and Patents Act 1988. Any unauthorised reproduction or modification of any images will constitute a breach of copyright. This includes making copies or ‘screen shots’ of images shared by the photographer online.
The Photographer may share previews of your images or give you access to an online gallery of images. These images must not be copied, screen shot, downloaded, edited or altered in any way.
If you wish to share photographs to your own network e.g. Facebook (or any other online platforms) you agree to do so only once you have purchased and paid for them.

Image Usage Rights

The Client(s) agrees that the Photographer may use any of the photographs to promote the business in advertising, including (but not limited to) web sites, social media platforms, brochures, magazine articles, competitions, etc. Should you wish to request that images are not used for such purposes, please email info@atlasphotography.co.uk to request this. We will then ensure your images are not used for these purposes.

Images

The Photographer during your photoshoot will be responsible for all creative choices of the images captured during the photoshoot, but will where possible take into account the Client’s reasonable instructions in respect of the photoshoot brief. Following completion of the shoot, the Photographer will deliver the final process as soon as reasonably possible, but cannot guarantee an urgent turnaround. RAW image files remain the property of the Photographer and will not be supplied.

Retouching

All images will be adjusted for exposure, brightness, contrast, sharpness, etc. The Photographer’s judgement relating to these corrections and the number of images offered to the Client shall be deemed correct. Retouching, digital manipulation etc is available to the Client as an option at extra cost.

Liability

The Photographer will take all reasonable steps to ensure that equipment is in good working order, backup equipment is available where appropriate and that images are backed up in a responsible manner. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
